What is non-provisional patent drafting?
Non-provisional patent drafting is the preparation of the full application that a patent office will examine and, if it is allowed, grant. The application contains the claims that define legal scope, a description that supports those claims, drawings, and the other formal sections. The drafting works from your input documents and follows the patent office requirements. It can begin from a provisional application you filed earlier, from an invention disclosure form, or from a novelty search you have already had done.
How is a non-provisional application different from a provisional one?
A non-provisional application is examined, and a provisional application is not. The provisional secures an early filing date and never grants on its own. The non-provisional carries the claim set that will be prosecuted, so its claims and its description have to be complete and consistent with each other. Anything relied on later needs support in the description as filed. That is why the drafting covers multiple embodiments, drawings, and dependent claims that leave room to amend during examination.
How are the claims drafted around prior art?
The first step is a set of independent claims that bypass the scope of the identified prior art, whether that art is taken alone or in combination. Scope is set to stay clear of what has already been disclosed while still covering the invention as it is likely to be practised. Dependent claims are then written to give fallback positions, and the specification is written with multiple embodiments so that amendments made during prosecution have support in the application as filed.
