The Problem
Our client, a leading global telecommunications provider, encountered a significant challenge in managing its expensive patent portfolio. The company’s patent portfolio comprises thousands of patents spanning multiple technologies and standards, making it increasingly difficult to understand the intricate relationships between its patents and critical telecommunications standards. The company’s objective was to gain a deeper understanding of how its patents align with critical telecommunications standards, specifically 5G (fifth-generation mobile networks), HEVC (High-Efficiency Video Coding), and WiFi 6 (the sixth generation of WiFi). The company needed to identify which patents were essential to these standards, which were non-essential, and how its patent portfolio could be optimized to support its business objectives.
HOW WE SOLVED IT
Our team reviewed the patents and claim charts provided by our client and built a strategy and parameters that need to be considered during the detailed analysis. We noted that quite a few patents were charted against both the HEVC and VVC standards.
We assigned the patents of these two companies among our team of experts. One team handled 63 patents of a company while the other team worked on 72 patents of another company.
We added a detailed comment on irregularities found in the mapping, where the wrong evidence was mapped with the claim elements. In some cases, the inventive step was not mapped with any evidence. We gave a score on irregularities based on its severity level.

On succesful review of all the patents, we brought out the following results to the client:
· Only 68% of all patents had no major quality issues.
· 13% of the patents had some issues and required revisions.
· The remaining 19% of the patents were wrongly mapped and not essential. We provided detailed reasoning for why these claim charts are incorrect.
We also prepared a detailed report mentioning all the errors and their severity in the claim charts. We flagged exclusively the patents that were rejected due to wrong claim charts.
The results helped the client negotiate with the patent holder and secured a better deal.
