Invalidating SEPs is challenging. We must identify documents, whether individually or in combination, that the examiner missed during prosecution and that can challenge the granted claims. We estimate that the probability of finding strong prior art for SEPs is 80% among contribution documents.

Many documents submitted during the standardization process are an excellent source for uncovering prior art.
