What does essentiality mean for a patent?
A patent is essential to a standard when it is not possible to implement the standard, or a mandatory part of it, without practising the claim. We check each claim against the specification text, section by section, and record whether it reads on mandatory or optional features.
Do you assess declared and undeclared patents?
Both. Declared families are checked against the sections they were declared for. For undeclared portfolios we identify which families read on the standard and which do not.
